These Terms & Conditions (“Terms”) govern your access to and use of the website aihia.net (the “Website”) operated by AIHIA UG (haftungsbeschränkt) (“AIHIA,” “we,” “us,” “our”).

By accessing or using the Website, you agree to be bound by these Terms. If you do not agree, do not use the Website.

The Website provides information about our boutique influencer marketing services and allows you to contact us (e.g., via contact form) and potentially request proposals or other business communications.

You must be legally capable of entering into a binding agreement to use this Website. If you use the Website on behalf of a company, you confirm that you have authority to bind that company.

If there is a conflict between these Terms and a signed services agreement, the services agreement will control for the services.

7) Intellectual property

All content on the Website (including text, graphics, logos, visuals, and layout) is owned by or licensed to AIHIA and is protected by intellectual property laws.
You may view and use the Website for your internal, lawful purposes only. You must not copy, reproduce, modify, distribute, or exploit Website content without our prior written permission, except where permitted by mandatory law.

8) Acceptable use

You agree not to:

  • misuse the Website or attempt to gain unauthorized access to it, its servers, or related systems;

  • interfere with security, performance, or availability;

  • use bots/scrapers to extract data without permission;

  • transmit malware, spam, or harmful code;

  • use the Website in a way that infringes intellectual property, privacy, or other rights.

14) Compliance note for influencer marketing (if/when services are provided)

If you engage AIHIA for influencer marketing services, you agree (in addition to any services agreement) to comply with:

  • applicable advertising/consumer protection laws (including disclosure obligations such as “ad”/“paid partnership” where required),

  • platform policies (e.g., YouTube/TikTok/Instagram/Twitch rules),

  • intellectual property rights (music, footage, trademarks, etc.),

  • any campaign-specific compliance requirements communicated in writing.

15) Termination

We may suspend or restrict access to the Website immediately if we reasonably believe you are violating these Terms or creating security or legal risks.

16) Governing law and jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany, excluding conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods (CISG), where applicable.

If you are a merchant (Kaufmann), a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction is Berlin, Germany.

17) Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full force and effect.
